DEFINITIONS
All defined terms in the Original Terms are incorporated herein by reference.
“Campaign Content” means the Geek the Library public awareness campaign related reports, guides, electronic files (including but not limited to, photo and text files), ads, forums, information and other materials that may only be accessed through the Web Site through authorization numbers and passwords.
AGREEMENT TO THESE TERMS
Your use of Features, Campaign Content and/or the Web Site signifies Your agreement to be bound by these Terms. Accordingly, You should read these Terms carefully prior to accessing the Web Site and using Features or Campaign Content. The Terms are available via a link appearing on the Web Site. OCLC may change these Terms at any time in its sole discretion. OCLC will issue notice of changes by e-mail, a change notice posted on the Web Site or any other means reasonably calculated to provide notice. If any change is unacceptable, Your only recourse is to cease using the Web Site and Campaign Content. Your continued use of the Web Site and/or Campaign Content following OCLC’s issuance of notification of a change to these Terms or posting of a new version of these Terms on the Web Site will constitute Your binding acceptance of the change or such new agreement (whichever applies).
USE OF CAMPAIGN CONTENT
Registration. The Web Site offers You the opportunity to register for more information for the Geek the Library public awareness campaign. When You register, You may be required to submit certain personal information (including Your full name, city, state, e-mail address and job title) and information about Your library. OCLC may also require You to enter into further agreements or accept additional terms of use as a condition of accessing or using Campaign Content.
Authorization and Password. Access to Campaign Content may require use of authorization numbers and passwords. OCLC will provide You authorization numbers and passwords required to access Campaign Content. You may not share or otherwise disclose Your authorization numbers and passwords to third parties. You shall use reasonable efforts to safeguard the confidentiality of such authorization numbers and passwords. You are responsible for all use, including unauthorized use, of Campaign Content initiated by Your authorization numbers and passwords, and shall promptly notify OCLC in writing of lost or stolen passwords and authorization numbers or of any unauthorized use of Campaign Content. In the event that OCLC becomes aware of unauthorized use of authorization numbers and passwords and/or access to and use of Campaign Content, OCLC may issue new authorizations and passwords. You shall work with OCLC to a reasonable degree to terminate unauthorized use of Campaign Content. In the event of lost or stolen passwords, OCLC will issue new passwords and authorizations to You provided You are in compliance with these Terms.
Campaign Content. If OCLC provides You authorization numbers and passwords to access Campaign Content, OCLC grants You a nonexclusive, nontransferable license to access and use Campaign Content solely for the Purpose. All use of Campaign Content shall be in accordance with the “Material Guidelines” located at http://get.geekthelibrary.org/material-guidelines. OCLC may revoke this license at any time in its sole discretion.
You agree not to: use or permit use of Campaign Content for Commercial Use, political campaigning or lobbying activity; in any manner not expressly authorized by these Terms or in any unlawful manner; share or provide third parties with, or access to, Campaign Content; modify or alter Campaign Content in any way, unless OCLC has approved modification or alteration by notifying You, in which case such modification or alteration shall not violate the intellectual property or other rights of a third party; or remove or alter any notices appearing on Campaign Content.
Except as otherwise expressly indicated by these Terms, OCLC and/or its suppliers own all rights, title and interest, including, without limitation, all intellectual property rights, in and to Campaign Content and You acquire no rights in or to the Campaign Content.
If You use a bulletin board, forum or other social feature on this Web Site, or on any OCLC affiliated website, any personal information You submit there can be read, collected, or used by other users of the Web Site, and could be used to send You unsolicited messages. OCLC is not responsible for the personal information You choose to submit in these forums.
Personal Information. This get.geekthelibrary.org Web Site is hosted by OCLC’s service provider retained to host this Web Site, Squarespace, Inc., and all information collected via this Web Site is stored on servers owned or controlled by Squarespace, Inc. or its affiliates, partners or service providers. Information collected through this Web Site, including but not limited to personal information, may be stored and processed in the United States or any other country in which Squarespace, Inc. or its affiliates, partners or service providers maintain this Web Site facilities. By using this Web Site, you consent to any such transfer of information.
You hereby consent to use of Your personal information by OCLC and its subsidiaries and affiliates in ways that are consistent with OCLC’s Privacy Policy which can be accessed at http://www.oclc.org/worldcat/policies/privacy/. In addition to the uses stated in OCLC’s Privacy Policy and the Original Terms, You also consent to OCLC’s transfer of your personal information to Squarespace, Inc., and its affiliates, partners and service providers, solely to the extent necessary to provide this Web Site.
BREACH
OCLC may take measures to suspend Your access to this Web Site and/or Campaign Content immediately upon Your breach of these Terms pending Your correction of such breach.

THE CAMPAIGN CONTENT IS PROVIDED “AS IS” AND YOUR USE OF AND RELIANCE ON THE CAMPAIGN CONTENT IS SOLELY AT YOUR OWN RISK. OCLC DOES NOT REPRESENT OR WARRANT THE COMPLETENESS, PERFORMANCE, ACCURACY OR ANY OTHER ASPECT OF THE CAMPAIGN CONTENT.
OCLC, ITS SUBSIDIARIES AND AFFILIATES AND THEIR RESPECTIVE SUPPLIERS DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EXPRESS AND IMPLIED, CONCERNING THE CAMPAIGN CONTENT INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE AND NONINFRINGEMENT. IN NO EVENT SHALL OCLC, ITS SUBSIDIARIES OR AFFILIATES OR THEIR RESPECTIVE SUPPLIERS HAVE ANY LIABILITY WHATSOEVER FOR, AND YOU HEREBY EXPRESSLY RELEASE EACH FROM, DAMAGES OR LIABILITY OF ANY KIND ARISING FROM CLAIMS RELATED TO THE CAMPAIGN CONTENT, REGARDLESS OF WHETHER OR NOT THE RELEASED PARTY HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. If you are a California resident, You waive your rights under California Civil Code § 1542, which states, "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." Residents of other states and nations similarly waive their rights under analogous laws, statutes, or regulations. Some states do not permit the exclusion of warranties, so the above warranty exclusions may not apply to You.
Neither party shall have any liability or obligation to the other for indirect, incidental, consequential or exemplary damages (including, without limitation, lost profits, loss of business, or loss of or damage to data) whether based on contract, tort or any other legal theory and regardless of whether a party foresaw such damages.
MISCELLANEOUS
These Terms constitute the complete, final and exclusive statement of the parties' agreement with respect to the subject matter hereof and are not intended to confer upon any person other than the parties hereto any rights or remedies. Except as otherwise provided for herein, these Terms may be modified only by means of a written document executed by each of the parties.
